13.07.2015 In the above captioned two applications, transit bail is sought in
FIR No.105/2015, under Sections 420/120B of the IPG, registered at police station Ferozepur, Punjab is sought.
2015:DHC:10569 Since the relief sought in the above captioned two applications is on identical grounds, therefore, with the consent of counsel representing both the sides, these applications have been heard together and are being disposed ofby this common order.
\ Learned senior counsel for petitioners has placed on record additional affidavit on behalfof petitioner-yf^/iw/z Sethi and submits that similar affidavits on behalf of other petitioners are already on record to point out that few days back, Punjab Police had come to Delhi to arrest the petitioners. Along with the additional affidavits, copy of residence proof of petitioners is also appended. Learned senior counsel for petitioners draws attention ofthis Court to an order of IS^*" May, 2012
(Annexure-E) in the consumer complaint filed by the complainant ofthis
FIR to submit that no offence is made out against petitioners.
This is an aspect which has to be seen by the court concerned.
Upon notice, Mr. Jayant K. Sud, learned Additional Advocate
General for respondent- State ofPunjab submits that warrant ofarrest are not issued but Notice under Section 41A ofthe Cr.P.C. was issued against petitioners tojoin investigation.
Learned senior counsel for petitioners submits that petitioners need protection to join the investigation in this FIR case and for this purpose, transit bail for aweek begranted.
Learned Additional Advocate General submits that transit bail of threedays will suffice.
In the facts and circumstances ofthis case and without commenting on the merits, petitioners are granted transit bail for aperiod offive days
BailAppl.No.1355/2015 Page 2 BailAppl.No.1345/2015 to enable them to approach the concerned Court ofSessions at Ferozpur inPunjab to avail oftheremedy as available inthelaw.
With aforesaid directions, the above captioned two petitions and applications are disposed of.
