JUDGMENT
(ORAL)

1. The accused/applicant seeks to be released on interim bail in case FIR No.300/2023 of PS Ambedkar Nagar for offences under Section 364A/302/201/120B IPC and 27/54/59, Arms Act. The interim bail is sought on medical grounds.

2. In furtherance of last order, the jail authorities filed an updated medical status report dated 01.05.2025. As per the said report, general condition of the accused/applicant is now stable and all medications as applicable are being provided to him from the jail dispensary itself and he can be granted treatment in jail as well as jail-referred government hospital. Further, the CMO of the jail has also reported that despite repeated requests, the accused/applicant has not provided previous/recent medical documents KATHPALIA Date: 2025.05.06 18:33:52 +05'30' Bail Application 1188/2025 pages related to his ongoing medical/physiotherapy treatment at Max Hospital and Dr. Aggarwal Physio Centre till date.

3. Learned counsel for accused/applicant submits that the accused/ applicant is not being provided a hygienic western toilet, stick for support and regular physiotherapy. So far as the physiotherapy is concerned, as per medical status report, the same can be and is being provided. So far as western toilet and stick are concerned, the accused/applicant may move an appropriate application before the concerned Jail Superintendent, who shall consider the same sympathetically and depending upon the outcome, the accused/applicant may institute appropriate legal proceedings.

4. Learned APP strongly opposes the bail application submitting that the seriousness of the offence, with which the accused/applicant has been charged cannot be ignored, so the interim bail may not be granted.

5. In view of the medical status report, I do not find any ground to grant interim bail to the accused/applicant on medical grounds. The application is dismissed. However, Jail Authorities shall provide best possible medical treatment to the accused/applicant. Copy of this order be immediately sent to the concerned Jail Superintendent.
