ORDER
1. This petition by way of Public Interest Litigation has been filed seeking a direction for court monitored investigation by the CBI or a committee constituted by this court into the alleged violation of the provisions of the Income Tax Act, 1961 as well as other laws by the second respondent Bank andmisuse ofpublic funds.
2. The petitioner who claims to be aretired Government servant of State 4 of Rajasthan made several allegations of misutilization of public funds by the second respondent Bank. It is also alleged that the second respondent Bank had failed to file the Returns as required under the Income Tax Act withregardto the fiinge benefitspaidto its employees.
3. Having heard the learned counsel for the petitioner as well as Shri Rajesh Gogna, the learned Standing Counsel who appeared on behalf of the 2015:DHC:11165-DB Government of India on advance notice and keeping in view that the petitioner has already made a representation to the first respondent on 22.08.2014 bringing to its notice the above-mentioned alleged irregularities, we deem it appropriate to dispose ofthe writ petition with a direction to the first respondent to consider the contents of the representation of the petitioner dated 22.08.2014 and in case the first respondent finds that the allegations made by the petitioner require due inquiry, the second respondent Bank shall be given an opportunity to respond and thereafter further steps be taken in accordance with law. Writ petition is accordingly disposed of. No costs.
