06.07.2015 Heard the counsel for the petitioner. State and the complainant who is
2015:DHC:10694 present in person. The petitioners are the elder brother-in-law (jeth), married sister-in-law(nanad) andelder sister-in-law(jethani) of the deceased, respectively.
The deceased was found hanging from the roof of the house in Sabzi
Mandi area of Malka Ganj. She was brought dead at Pentamed Hospital, Gujrawala Town, Delhi.
On post-mortem, no external injury was found.
The complainant who is present in person, has raised certain allegations about the police being in cahoots with accused persons. He further submits that deliberately the deceased was not taken to nearby hospital but to a far flung area and, therefore, she could not survive. He also states that the photographs of the deceased revealed that she was forcibly hanged with the ceiling so as to give an adroit appearance of suicide.
During the course of hearing, status report was filed by the counsel for the State. Let it be taken on record.
A perusal of the status report would show that after investigation, charge sheet has been submittedagainst all the accusedpersons. After arrest, the husband ofthe deceasedwas releasedon bail by the Court below.
The petitioners were granted interimprotection by an order dated
January, 2015.
Considering the circumstances of the case, as also the fact that charge sheet has been submitted and law will take its own course, this Court is inclinedto make the interim order in favour ofthe petitioners absolute.
The petitioners, however, would furnish fresh bail bonds in the sum of
Rs.25,000/- with two surities of the like amount each to the satisfaction of the Arresting Officer/SHO ofthe concerned Police Station.
Thisprotection would be subject to the following conditions
ORDER
1. The petitioners would not deliberately delay acceptance of police papers under Section 207 ofthe Code of Criminal Procedure.
2. The petitioners would not unnecessarily delay the conclusion of the trial.
3. The petitioners would not, in any way, approach the complainant or dissuade him in pursuing the matter before Court below. In case the petitioners flout anyone ofthe aforementioned conditions, the State would be at liberty to have the order of anticipatory bail cancelled. This opportunity is available to the complainant as well. Thebail applications are allowed and disposed of accordingly. Orders be given Dasti under the signature ofthe Court Master.
