Learned counsel for the parties seek disposal of the suits in terms of the Settlement Agreement dated 8111 June, 2015 arrived at between them.
Their joint application under Order 23 Rule 3 read with Section 151 CPC seeking disposal of the suits in terms thereof. The application is taken on record. Let it be numbered by the registry. The application is signed by the plaintiff and the defendants along with their counsel. It is also supported by their corresponding affidavits. The Court has perused the application and the Settlement Agreement. The terms therein are lawful. The Settlement
Deed is marked as Ex.C-l. The Settlement Deed, inter alia, envisages withdrawal of criminal complaint by the wife of the plaintiff -Sun ii Kapoor, who has filed an application and has also appended her signature to the
Settlement Deed.
All the parties to the application including Ms. Sonia Kapoor, are present in Court. Ms. Sonia Kapoor is identified by Mr. Girish Aggarwal, Advocate. All the parties assure this Court that they shall be bound by the assurances and undertakings in the settlement agreement and the application.
The same are accepted by the Court. Since the Us has been settled, the application under Order 23 Rule 3 is allowed.
The suit is decreed in terms of the settlement. The suit as well as all pending applications are disposed off accordingly.
