Sanjay Kumar Pandey & Anr v. Modern Foods Industries (I) Ltd

1. On August 06, 2015 the following order was passed: - "Whereas the Appellants are agreeable to resolve the dispute by receiving ^ lakhs each as compensation infull and final settlement of their claims, learned counselfor the Respondent seeks a week's time to revert after consulting the Management ofthe Respondent. 2. Learned counsel for the respondent states that the management of the respondent is agreeable to pay compensation in sum of ^"2 lakhs to both the appellants. In the order dated August 06, 2015 we had already recorded the consent of the appellants to resolve the dispute by receiving ?2 lakhs as compensation in full and final settlement of their claims.

3. The appellants were personally present in Court on August 06, 2015 as recorded in the memo of appearance in the order of said date.

4. We dispose of the appeals recording the settlement as aforesaid simultaneously directing the respondent to pay by means of cheque ?2 lakhs to each of the appellants. The payment shall be made within two weeks from today. The claims of the appellants against the respondent which are the subject matter of the dispute in the appeal shall be satisfied when the cheques are encashed.

5. It is agreed that learned counsel for the respondent shall obtain the cheques payable to the appellants from his client and would hand over the cheques to learned counsel for the appellants who would obtain pre-receipts from the appellants and would hand overthe receipt(s) simultaneously when the cheques are received.

6. Since payment is being made on a settlement and under the order of the Court full amount of ^2 lakhs would be paid to the appellants without deduction towards any tax liability.

7. No costs.
