JUDGMENT

1. The present suit was listed before the Vacation Bench on 17.6.2015 when summons were issued in the suit returnable for a short date, i.e., 24.6.2015. On 24.6.2015, the Vacation Bench had noted that summons in the suit and notice in the applications could not be issued as the process fee was not filed. Pertinently, none had appeared for the plaintiff on the said date, but no adverse orders were passed. Instead, fresh summons in the suit and notice in the applications were directed to be issued, returnable for today. Same is the position even today. The plaintiff has not filed the process fee, nor is any counsel present on his behalf.

2. It appears that the plaintiff is not interested in prosecuting the present suit, which is accordingly dismissed in default and for nonprosecution, along with the pending applications. JULY 30, 2015/sk/rkb HIMA KOHLI, J
