Shishu Pal Chauhan v. Sudesh Tyagi & Anr.

1. Both the petitions have been taken up together as same and identical issue has been raised therein.

2. The petitioner is aggrieved by the fact that he has not been permitted to be impleaded in the two suits in question. According to him, his application moved under Order I Rule 10 CPC should have been allowed by the learned Trial Court. CM(M) 3427/2024 & CM(M) 3429/2024 2

3. The next date in both the abovesaid petitions is 27.10.2025.

4. However, in view of the intervening development, petitioner, in both the petitions, has moved application seeking withdrawal of the present two petitions.

5. It is submitted that the petitioner/applicant has already re-transferred his interest in the suit property to one Ms. Anju Tyagi and the petitioner has even withdrawn his claim in the pending suits and, therefore, he does not seek his impleadment in any of the suits.

6. It is in the abovesaid subsequent development that the applications have been moved seeking withdrawal of the present two petitions.

7. In view of the averments made in the applications and after hearing Mr. Rana, learned counsel for petitioner, while allowing the abovesaid applications, both the abovesaid petitions are hereby disposed of as withdrawn.

8. The pending applications also stands disposed of in aforesaid terms.

9. The next date i.e. 27.10.2025 stands cancelled.
