14.08.2015 These are two cross FIRs. There are two joint petitions seeking quashing of the FIRs. FIR no.103/2013 registered under Sections
323/325/341/354/509 of the IPC at police station Pandav Nagar on the complaint of Veena Batra. FIR no.104/2013 registered under Sections
323/354/509 of the IPC at the same police station on the complaint of
Meenakshi Arora. Learned counsel for the petitioner submits that this
2015:DHC:11294 FNA was by and large a landlord-tenant dispute which has escalated and due to misunderstanding cross FIRs have got registered.
Complainant/respondent no.2 is present in person in Court. Presence of the complainant has been identified by the Investigating officer. It is stated that now with the intervention of the elders of the society the parties have settled their disputes and they have no grievance or complaint left against one another. They accordingly pray that both these FIRs be quashed.
Learned APP for the State submits that if at all the present FIRs are permitted to be quashed it should be quashed subject to costs as the challan has been filed and the State machinery has been put in to motion and the State has incurred expenses.
Accordingly, FIR no.103/2013 registered under Sections
323/325/341/354/509 of the IPC and FIR no.104/2013 registered under Sections 323/354/509 of the IPC at police station Pandav Nagar as also the proceedings emanating therefrom are quashed subject to payment of Rs.20,000/- to be deposited by the petitioners in the account of Juvenile Justice Board maintai4d with the UCO Bank within two weeks.
Petitions disposed of.
