10.08.2015 These are joint petitions filed by the petitioners and respondents in the respective petitions seeking quashing ofthe two cross FIR. FIR
No.308/2011 has been registered under Sections 354/506/341 of the
2015:DHC:11289 IPG on the complaint of complainant "HM". FIR No.258/2011 has been registered under sections 382/34 of the IPG on the complaint of
Raj Bir Singh. Both the FIRs have been registered at police station
Prashant Vihar. Gomplainants in the respective FIRs are present in person; their presence has been identified by the counsel for the complainant "HM".
Gontents of the FIRs have been perused.
It is stated that the present FIR has been registered due to misunderstanding and misapprehension and now with the intervention of the elders of the society the parties have settled their disputes and they have no grievance or complaint left against one another. They accordingly pray that the present FIRs be quashed.
Learned APP for the State submits that if at all the present FIR is permitted to be quashed it should be quashed subject to costs as the charge sheet has been filed and the State has incurred expenses.
Accordingly, FIR No.308/2011 registered under Sections
354/506/341 of the IPG at police station Prashant Vihar as also the proceedings emanating therefrom are quashed subject to payment of
Rs.25,000/- out of which Rs.20,000/- be paid to the complainant and
Rs.5000 be deposited by the petitioner in the account of Juvenile
Justice Board maintained with the UGO Bank, Delhi High Gourt
Branch. FIR No.258/20II registered under sections 382/34 of the
IPG at police station Prashant Vihar as also the proceedings emanating therefrom are quashed subject to payment of Rs.5,000/- to be deposited by the petitioner in the account of Juvenile Justice Board maintained with the UGO Banlc, Delhi High Gourt Branch.
