07.08.2015 These are two petitions seeking quashing of the cross FIRs which had been registered inter-se the parties. FIR No. 209/2015 has been registered under Sections 3 54/452/509 of the IPC on the complainant of respondent No. 6. Respondent No. 6 is Kusum. She was not medically examined on her own request.
FIR No. 207/2015 has been registered under Sections
3 54/452/509 of the IPC on the complainant of respondent Sunita.
2015:DHC:11286 The complainants are present. Their presence has been identified by the Investigating officer.
Contents of the FIR have been perused. Parties are distantly related. It is stated that these FIRs have been registered due to misunderstanding and misapprehension and they have now settled the matter with the intervention of the elders. Parties have drawn up a compromise and do not wish to pursue these litigations any further.
They accordingly pray that the present FIRs be quashed.
Learned APP for the State submits that if at all the present FIRs are permitted to be quashed it should be quashed subject to costs as the State machinery has been put in to motion and the State has incurred expenses.
Noting the above factual matrix, FIR No. 209/2015 registered under Sections 354/452/509 of the IPC and FIR No. 207/2015 registered under Sections 354/452/509 of the IPC at PS Naraina as also the proceedings emanating therefrom are quashed subject to payment of Rs.25,000/- to be deposited by each of the petitioner in both the petitions in the account of Delhi High Court Legal Services
Committee within two weeks.
