11.08.2015 The present petition -^has been filed by the petitioner under
Article 226/227 ofthe Constitution ofIndia seeking a direction to the respondents to immediately release around 83 persons who, as per the petitioner, were illegally detained by the local police.
During the course of hearing of the present matter, we have
2015:DHC:11643-DB been apprised by Inspector Sanjeev Kumar of PS; Parliament Street that all the said persons were produced before the Special Executive
Magistrate and an order has been passed by the Special Executive
Magistrate directing release of all the 83 persons who were detained by the local police. He further confirms the fact that all the 83 persons stand released.
The petitioner, appearing in person, prays that appropriate actionbe taken against those involved in the illegal detention of these
83 persons, who were peacefully sitting in protest at Jantar Mantar, which is their fundamental right under Article 19 of the Constitution of India, but, nevertheless, they were illegally detained by the local police in violation of directions of the Supreme Court in D.K.Basu v.
State of WestBengal; AIR 1997SC 610.
After some arguments, the petitioner appearing in person, reserves liberty to take up all these pleas by filing a substantive petition.
Reserving that liberty to the petitioner, the petition is disposed of considering the fact that all the 83 persons have been released by the police.
It is made clearthat if any person is still under illegal detention ofthe local police, he/she be released forthwith.
