19.08.2015 These are two joint petitions seeking quashing of the two cross
FIRs i.e. FIR No.64/2015 and FIR No.65/2015 registered at police station Gokul Pun relating to the same date i.e. 20.01.2015. In FIR
No.64/20 15 the complainant is Sujata Bhati. Her presence has been identified by the Investigating Officer. In the cross FIR No. 65/20 15, the complainant is Archana. She is also present and her presence has also been identified by the Investigating Officer. The first FIR has been registered under Sections 354A1342/323/34 of the IPC and the second
FIR i.e. FIR No. 65/20 15 has been registered under Section 354-
A/323/506/34 of the IPC.
2015:DHC:11297 Parties are neighbours. They have settled their disputes. It is stated that due to misunderstanding the misapprehension the present cross FIRs have been got registered by the respective parties. It is stated that the parties are closely intertwined in their neighbourhood and having mutually agreed to bring these proceedings to a close. It is stated that no fruitful purpose would be served in continuing these proceedings alive. They pray that the FIRs be quashed.
Learned APP for the State submits that if at all the present FIRs
P are permitted to be quashed it should be quashed subject to costs as in the first FIR statement of the victim has been recorded and even in the second FIR, investigation has been carried out and the State has incurred expenditure.
Accordingly, while allowing the prayers made in the present petitions as also quashing FIR No. 64/2015 registered under Sections
354A/342/323/34 of the IPC and FIR No. 65/20 15 registered under
Section 354-A/323/506/34 of the IPC at police station Gokul Pun the petitioners (in each petition) are burdened with the costs of Rs.20,000/- to be deposited in the account of Juvenile Justice Board maintained with the UCO Bank, Delhi High Court Branch.
Petitions disposed of.
