JUDGMENT

1. The case was passed over on the first call as none was present for the parties. Same is the position even on the second call.

2. On the last date of hearing, it was noted that the parties had remained in a settlement mode for one and a half year. As none had been appearing for the defendant after 6.2.2014, learned counsel for the plaintiff was directed to give a written intimation of the next date of hearing to the counsel for the defendants and place on record proof of intimation. However, neither has the counsel for the plaintiff presented himself today, nor has the proof of intimation of the next date of hearing to the other side, been placed on record.

3. It appears that the plaintiff is not interested in prosecuting the present suit, which is accordingly dismissed in default and for nonprosecution. HIMA KOHLI, J SEPTEMBER 08, 2015
