JUDGMENT

1. Allowed subject to just exceptions. W.P.(C) 9255/2015

2. Issue notice to the respondent.

3. Mr. Krishna accepts notice on behalf of the respondent.

4. In view of the directions that I propose to pass, the learned counsel for the respondent says that he does not wish to file a reply.

5. The substantive prayers sought for, in the captioned petition are as follows:- “..A. Issue an appropriate writ (s) / direction(s) or order (s) quashing the letters contained in Annexure P-1 and / or;

B. Issue an appropriate writ (s) / direction (s) or order (s) directing the INC to re-inspect the petitioner institution and consider the renewal of the permission for GNM course for 2015:DHC:8167 session 2015-2016...”

6. The learned counsel for the respondent states that vide the impugned communication dated 07.09.2015, deficiencies found have been communicated to the petitioner. It is his submission that if, compliance report is submitted by the petitioner and if, re-inspection fee is deposited, inspection would be carried out. 6.[1] It is further submitted that if, on inspection, deficiencies are found to be liquidated, then the recommendation for GNM course would obviously follow.

7. Having regard to the above, on the petitioner depositing the reinspection fee within two days from today, and submitting a compliance report within the same time frame, the respondent will carry out a re-inspection. 7.[1] Needless to say, the re-inspection will be carried out with due expedition, though not later than 10 days from today, keeping in mind that the last date of admission is 30.10.2015.

8. With the aforesaid observations in place, the captioned petition is disposed of.
