JUDGMENT

1. On 16.9.2015, last opportunity of two weeks was granted to the defendant to place on record the policy framed by APMC in the months of March-April, 2015 in respect of the unallotted phars. Further, the defendant was directed to inform the Court as to the timeline within which it shall implement the policy framed by it. However, the said affidavit has not been filed by the defendant.

2. Counsel for the defendants states that the affidavit was prepared and filed in the Registry only yesterday, with an advance copy to the other side. She hands over a copy thereof, which is taken on record.

3. The said affidavit has been filed by the Deputy Secretary, APMC, Azad Pur, Delhi, who has stated therein that temporary allotment of phars will be made strictly as per the rules of allotment framed by APMC, as enclosed with the affidavit. 2015:DHC:8215 CS(OS)No.2600/2014

4. In view of the aforesaid affidavit, counsel for the plaintiff seeks leave to withdraw the present suit, which is accordingly disposed of.
