JUDGMENT
1. Pursuant to the parties being referred to the Delhi High Court Mediation and Conciliation Centre, a Settlement Agreement dated 22.09.2015 has been forwarded.
2. The terms and conditions of the settlement have been set out in para 6 of the Settlement Agreement, whereunder the defendants have acknowledged the proprietary rights of the plaintiff in various trademarks as mentioned in para 6(i) of the Settlement Agreement. Further, the defendants have given a series of undertakings to the plaintiff and in view of the said undertakings, the plaintiff has agreed to give up the reliefs of damages and delivery up against the defendants. Counsels for the parties state that the suit may be 2015:DHC:8267 CS(OS) 1637/2014 decreed in terms of the Settlement Agreement and para 33(i) and (ii) of the plaint.
3. The Court has perused the Settlement Agreement dated 22.09.2015. The same has been signed by the constituted attorney of the plaintiff, the sole proprietor of the defendant No.1/firm and by the defendant No.2 in his personal capacity, by their respective counsels, as also the learned Mediator.
4. As counsels for the parties jointly state that their clients have arrived at the aforesaid settlement of their own free will and volition and without any undue influence or coercion from any quarters, there appears no legal impediment in accepting the said settlement. The parties shall remain bound by the terms and conditions of the settlement recorded in the application.
5. The suit is decreed in accordance with the terms and conditions recorded in the Settlement Agreement dated 22.09.2015 and paras 33(i) and (ii) of the plaint. Decree sheet be drawn accordingly.
6. The suit is disposed of alongwith the pending application.
