Shyam Sunder v. Suraj Bhan

1. The case is listed before the Court by the Registry.

2. The present suit has been instituted by the plaintiff seeking partition of some immovable and movable properties stated to be owned by the HUF and the deceased father of the parties.

3. A perusal of the order sheets reveals that during the pendency of the suit, the parties had filed a joint compromise application stating inter alia that they had arrived at a settlement. Accordingly, vide order dated 16.12.1999, the suit was decreed in terms of the compromise. Thereafter, some proceedings had taken place for valuation of the suit property and for awaiting the valuation reports.

4. On 27.2.2002, the Joint Registrar had passed an order with regard to the valuation of the share of the parties, on which the extent 2015:DHC:8434 CS(OS) 1094/1992 of the stamp fee to be paid could be ascertained. However, neither party has approached the Court thereafter for further orders.

5. The suit having been decreed on 16.12.1999, nothing further survives for adjudication.
