13.10.2015 Despite invocation of the arbitration clause on 30.10.2014 in terms of notice dated 17.09.2014, the Arbitrator was not appointed within 30 days. An Arbitrator is sought to be appointed under Clause
3 ofthe agreement between the parties. The Arbitration Clause is not disputed.
In the circumstances, Mr. Justice B.A. Khan (Mobile NO. 9818000150), a former Judge of this Court and former Chief Justice of the Jammu & Kashmir High Court, is appointed as the Arbitrator.
The fees of the arbitration shall be fixed by learned Arbitrator himself.
These petitions stand disposed off in the above terms. A copy of this order shall be sent to the learned Arbitrator. The parties shall appear before the learned Arbitrator on 29.10.2015.
