15.10.2015 The present are applications under Section 438 of the Code of Criminal
Procedure, 1973 praying for pre-arrest bail in cross FIRs being FIR
No.598/2015 under Sections 308/323/34 IPC and FIR No.599/2015 under
Sections 308/324/323/34 IPC both registered at Pohce Station - Mahender Park, Delhi.
The present incident is the outcome of differences between members of
2015:DHC:10858 the same family. Complainant Naeem in FIR No.598/2015 and complainant
Nawab in FIR No.599/2015, who are present in person, state that with the intervention ofelders inthe family the dispute which resulted inthe registration ofthe subject cross FIRs has already been resolved amicably. The complainants state that in view of the settlement arrived at between the parties they do not wish to proceedwith the subjectcrossFIRs.
In viewof the foregoing, MsKolluru, learned APP appearing on behalfof the State, does not oppose the presentapplications.
The applicants in the subject FIRs have clean antecedents.
Consequently, the present applications are allowed. In the event of their arrest theapplicants shall bereleased onbail ontheir famishing a personal bond in the sum of Rs.10,000/- each with one surety of the like amount each to the satisfaction of the arresting officer/Station House Incharge subject to the condition thatthey shall maintain good behaviour forthe nextyear.
The applications are disposed of accordingly.
