29.10.2015 The petitioners seek anticipatory bail in FIR No.704/2015 (P.S. Nand
Nagari) instituted for offences under Sections, 451, 323 and 34 of the IPC.
One Mohd. Shakeel lodged the FIR alleging that on 16.7.2015 while he was coming to his house, he found two boys sitting on a motorcycle, which was parked in the middle of the road. When those boys were asked to
2015:DHC:10863 Rai remove their motorcycle, they indulged in verbal scuffle and affray but they were pacified by the passers by. It is alleged that thereafter petitioner and other co-accused persons came to the house of the informant and Wasim
Akram (petitioner in Bail Application No. 1692/2015) caught hold the hands of the petitioner, hit him with the bricks whereas the others assaulted the complainant with fists and kicks. The assault referred to above, it is alleged, resulted in the injuries on the head and eyes of the informant.
It has been submitted on behalf of the petitioners that one Meharban
Munna has been released on bail by the Court of learned Metropolitan
Magistrate, Kakardooma Courts.
The petitioners have a different story to narrate. They allege that the complainant is the aggressor and has caused injuries to the brother of
Nadeem for which, information was given to the Police. It is further submitted that the injury report does not specify whether the injuries were serious or simple in nature.
Considering the minor nature of accusation, the petitioners are directed to be released on bail, in the event of their arrest, on furnishing a bond in the sum of Rs. 10,000/- with two sureties of the like amount to the satisfaction of the arresting officer/SHO of the concerned Police Station.
However, it is made clear that they shall cooperate in the investigation of the case and would visit the Police Station as and when required by the
Investigating Officer/SHO of the concerned Police Station.
Applications are disposed of.
