JUDGMENT

1. Present writ petition has been filed by petitioner assailing the Order dated 7.10.2015 passed by Debts Recoveiy Appellate Tribunal whereby the appeal filed by the petitioner against the Order dated 21.8.2015 passed by Debts Recovery Tribunal,Jaipur,in SA No.57/2015,was dismissed.

2. During the course ofhearing,learned counsel for the petitioner had made / an offer to the respondent to settle the matter. Counsel for the respondent had also made a counter affidavitto the petitioner.

3. Today,Mr.Bhalla,learned counsel for the respondent,submits that in-case the petitioner is willing to settle the matter,the respondentBank is willing to give a deduction of Rs.5.00 laklis to the petitioner as a special case. 2015:DHC:11489-DB without it being treated as a precedent. Mr.Bhaila also submits that this offer will remain available for a period ofone week from today.

4. In view of the submission made by counsel for the respondent, learned counsel for the petitioner submits that he wishes to withdraw the present petition and application as the petitioner proposes to settle the matter with the respondent Banlc and would approach the bank for settlement.
