03.11.2015 Present are petitions under Article 226 of the Constitution ofIndia read with Section 482 ofthe Code ofCriminal Procedure, 1973 seeking quashing of cross FIRs, one FIR bearing No.231/2015 under Sections 323/341/34 IPC registered at Police Station- Hazrat Nizamuddin, Delhi and the other FIR bearing No.232/2015 under Sections 324/34 IPC registered at Police Station-
Hazrat Nizamuddin, Delhi and the proceedings arising therefrom.
The dispute between the parties arose as aconsequence of ascuffle over
2015:DHC:11088 the construction of a Jhuggi. The parties are stated to have resorted to physical assault against each other. The FIR No.231/2015 has been registered on a complaint filed by complainant Rashida whereas the FIR No.232/2015 has been registered on a complaint filed by Mohd. Arif.
Rashida, the complainant in WP(Crl.) 2519/2015 as well as Mohd. Arif, the complainant inWP(Crl.) 2523/2015, who are present incourt and identified by10 SI Bharat Singh, PS- Hazrat Nizamuddin, state that with the intervention ofneighbours they have arrived at an amicable resolution ofthe disputes that ledto the registration of the subject FIRs and in view of the amicable resolution" of all their outstanding disputes, they are no longer keen to proceed with the subject FIRs and the proceedings arising therefrom.
In view ofthe foregoing no useful purpose will be served by proceeding with thesubject FIRs. Resultantly, FIRNo.231/2015 under Sections 323/341/34
IPG registered at Police Station- Hazrat Nizamuddin, Delhi and FIR
No.232/2015 under Sections 324/34 IPG registered at Police Station- Hazrat
Nizamuddin, Delhi and the proceedings arising therefrom are set aside and quashed qua the respective petitioners subject to their maintaining good behaviour for aperiod ofone year from today.
With the above said directions, the present writ petitions are allowed and disposed of accordingly.
