04.11.2015 Parties are seeking quashing of two eross-FIRs. FIR
No.257/2013 has been registered under Sections 232/354/506/34 of the IPC at police station Ranjeet Nagar on the complaint of "PR".
2015:DHC:11310 The second FIR i.e. FIR No.256/2013 has got registered under
Sections 323/354/34 IPC at the same police station on the complaint of'TC".
Contents ofthe FIRs have been perused.
Parties have a landlord and tenant relationship; they are neighbours. They have settled their disputes before the Mediation
Centre, Tis Hazari Courts. A copy of the settlement is a part of the record. This position is endorsed by the complainant in each of the
FIRs. Both the complainants are present in person. Their presence has been identified by the Investigating Officer. No grievance has left against one another. Parties pray that both the FIR be quashed.
Learned APP for the State submits that if at all the present FIRs are permitted to be quashed it should be quashed subject to costs as the State machinery has been put in to motion and the State has incurred expenses.
Accordingly, FIR No.257/2013 registered under Sections
232/354/506/34 of the IPC and the second FIR i.e. FIR No.256/2013 registered under Sections 323/354/34 IPC both at police station
Ranjeet Nagar as also all the proceedings emanating therefrom are quashed subject to payment of Rs.20,000/- (in each of the two FIRs) to be deposited by the petitioners in the account qf the Delhi High
Court Legal Services Committee.
Petition disposed of.
