The application is disposed of accordingly.
JUDGMENT
1. The present is a petition under Article 226 of the Constitution of India praying as follows:- 2015:DHC:9189-DB “(i) That a writ of prohibition/mandamus or any other appropriate writ or order or direction may be passed in favour of the petitioners and against the respondents thereby restraining the respondents or any other person not to interfere in the matrimonial life of the petitioners and not to harass the petitioners in any manner whatsoever, in the interest of justice;
(ii) That this Hon’ble Court may be pleased to direct the respondent No.2 and 3 not to implicate the petitioners in any false criminal cases or complaints lodged by respondent No.4 & 5 or any of his family members and ensure their safety and security from respondent No.4 & 5 or any of his family members and ensure their safety and security from respondent No.4 & 5, other family members, friends or any other person in the peaceful life of the petitioners and also to ensure the safety and security of the petitioner from the respondent No.4 & 5 or any of his family members, friends or any other person, in the interest of justice;
(iii) Any other or further order which this
Hon’ble Court deems fit and proper in the facts and circumstances of the case may also be passed in favour of the petitioner.”
2. Notice.
3. Ms. Kapoor, learned Additional Standing Counsel (Criminal) accepts notice on behalf of respondent Nos.[1] to 3 and states that in view of the averments made in the present petition, the police shall afford adequate protection to the petitioners who are a newly married couple.
4. In view of the directions that are proposed to be issued and the circumstance that no orders are being passed against respondent Nos.[4] and 5, it is neither just nor necessary to issue notice to the said respondents.
5. Ms. Kapoor, learned Additional Standing Counsel (Criminal) states that the SHO of the concerned Police Station shall provide adequate protection to the petitioners. The beat constable of the concerned area shall also be sensitized in this behalf. The telephone number of the SHO of the concerned police station as well as the beat constable shall be provided to the petitioners in order to enable them to contact the former in the event of any threat or apprehension.
6. Ordered accordingly.
7. With above directions the writ petition is disposed of. The pending application also stands disposed of.
8. A copy of this order be given dasti under signatures of Court Master to counsel for the parties.
