ORDER

1. Having heard learned counsel for the appellant we do not find any case made out to interfere with the impugned decision dated May 19, 2015 for the reason while upholding the order passed in appeal by the District Judge, which in turn upheld the eviction order passed by the Estate Officer, the learned Single Judge has dealt with all the contentions advanced.

2. Same contentions are being advanced before us.

3. Though this is the first Intra-Court Appeal, but as amatter offact is a second appeal. The first appeal against the impugned order was under the Public Premises (Eviction ofUnauthorized Occupants) Act, 1971 before the LPA 810/2015 & conn.matters Page 7 of[9] 2015:DHC:11327-DB District Judge. The order passed in appeal was challenged before the learned Single Judge. The Intra-Court Appeal is thus the third tier before ajudicial fora.

4. The undisputed position is that the lease in favour of the Delhi Peasants Co-Operative Multipurpose Society, granted by the erstwhile Delhi Improvement Trust, has expired. Delhi Development Authority is the successor-in-interest. The lease has not been renewed.

5. Resolution No.6 passed by a committee of officers of the Delhi Development Authority on which the appellants rely has been noted and considered by the District Judge as also the learned Single Judge. Correct view has been taken. Unless a resolution is formally notified and communicated to aparty, no rights are created thereunder. Besides, the learned Single Judge has rightly observed that the resolution only seeks to put in place an interim arrangement.

6. The contention that the land cannot be used for aBio-diversity Park is neither here nor there for the reason the land in question is part ofeither the bank or flood plain of river Yamuna. There are numerous authorities concerning environmental issues requiring the land to be maintained either as it is or used as aBio-diversity Park i.e. have aplantation ofakind where river Yamuna is rejuvenated.

7. The appeals are dismissed inlimine.
